Tyre Nichols was 'defenseless' during his 'savage' beating by police

Tyre Nichols was "defenseless" during the "savage" beating by Memphis police officers that preceded his death earlier this month, attorneys for his family said at a Monday press conference.

Earlier in the day, law enforcement officials privately met with Nichols' family members and their attorneys to show them video footage of the police stop, which has not yet been released to the public.

Attorney Antonio Romanucci described a violent scene. "He was a human piñata for those police officers," Romanucci said. "It was an unadulterated, unabashed nonstop beating of this young boy for three minutes."

Crump, one of the family's attorneys, said Nichols was tased, pepper sprayed and restrained during the incident, part of which occurred about 80 yards from where Nichols lived with his mother and stepfather. Crump said Nichols could be heard calling out for his mother just before the video ended.

DA: 5 Memphis cops ‘all responsible’ for Tyre Nichols’ death
By ADRIAN SAINZ and REBECCA REYNOLDS
January 26, 2023 GMT

MEMPHIS, Tenn.. (AP) — Five fired Memphis police officers were charged Thursday with second-degree murder and other crimes in the arrest and death of Tyre Nichols, a Black motorist who died three days after a confrontation with the officers during a traffic stop.

Shelby County Sheriff’s Office online records show that Tadarrius Bean, Demetrius Haley, Desmond Mills, Jr., Emmitt Martin III and Justin Smith, who are all Black, were in custody. All five are charged with second-degree murder, aggravated assault, aggravated kidnapping, official misconduct and official oppression.

Court records don’t list attorneys for Smith, Bean or Haley. Martin’s lawyer, William Massey, confirmed that his client had turned himself in. He and Mills’ lawyer, Blake Ballin, said they planned to discuss the charges at a news conference later Thursday.

Second-degree murder is punishable by 15 to 60 years in prison under Tennessee law.

Nichols’ stepfather, Rodney Wells, told The Associated Press by phone that he and his wife RowVaughn Wells, who is Nichols’ mother, discussed the second-degree murder charges and are “fine with it.” They had pushed for first-degree murder charges.

“There’s other charges, so I’m all right with that,” he said.

He said he was “ecstatic” that authorities have moved quickly in the case.

The family’s attorneys, Ben Crump and Antonio Romanucci, issued a statement praising the charges.

The news today from Memphis officials that these five officers are being held criminally accountable for their deadly and brutal actions gives us hope as we continue to push for justice for Tyre,” they wrote. “This young man lost his life in a particularly disgusting manner that points to the desperate need for change and reform to ensure this violence stops occurring during low-threat procedures, like in this case, a traffic stop.”

The Rev. Al Sharpton, who founded and runs the National Action Network and will deliver the eulogy at Nichols’ funeral service next week, called the charges “a necessary step in delivering justice” for Nichols.

There is no point to putting a body camera on a cop if you aren’t going to hold them accountable when the footage shows them relentlessly beating a man to death,” Sharpton said. “Firings are not enough. Indictments and arrests are not convictions. As we’ve done in the past...we will stand by this family until justice is done.”

Shelby County District Attorney Steve Mulroy said he would provide an update on the state’s investigation Thursday afternoon.

Nichols’ family and their attorneys have seen police video of the arrest, but the video hasn’t been released to the public, though authorities said they’d release it this week or next.

The Memphis police chief has called the actions of five officers involved in the violent arrest of Nichols “heinous, reckless and inhumane” and urged residents of the predominantly Black city to protest peacefully when video is released.

I do not care if they are Black.  Bad police need to be held accountable.  This incident (Black police being accused of abuse) is not a surprise to many.

There are conservatives trying to spin this in saying how quiet protestors and civil right groups are right now.

This incident is being reported internationally.  France 24 on Free Speech TV is one media outlet.

Well EB maybe you should care about the color.  It does seem that when white officers engage in bad conduct or worse they are put on paid leave until a thorough (almost 2 year investigation is done).  And even then if charges are lodged they are minuscule in comparison.  Nobody is excusing the bad behavior of these black cops, because if there was wrong doing then they should be held accountable.  But intelligent beings can't help but notice the difference in how white cops are handled after bludgeoning or killing a negro vs black cops.

One would only have to look at the protection and cover up that the white cops received in Louisiana after killing Ronald Greene.  https://en.wikipedia.org/wiki/Killing_of_Ronald_Greene

The Louisiana State Police tried to back the officers after knowing the officers made several false statements regarding Greene's death and was quoted as saying the incident was "awful but lawful."  They savagely beat the you know what out of Ronald Green in May of 2019 and was finally formally charged after pressure in December of 2022.  That is nearly 4 years later.  The worse part is only one officer was charged with "NEGLIGENT homicide" and the other three with malfeasance in office.

This incident in Memphis just happened on Jan 10th, 2023,  I am typing this as of Jan. 27th, 2023 and these NEGRO cops are immediately charged with MURDER.  Not a lesser negligent homicide or manslaughter.  And best believe ALL THE NEGRO cops are charged accordingly.  They are held jointly and severally liable and will all face the same fate.  And this was done Post Haste.

Again, I'm not saying if they were unjustified, they shouldn't be held accountable, but I can't help but notice how even black cops are rushed to judgement while white cops get to stay on the payroll and have a LONG AND THOROUGH investigation with every of the doubt.

Notice when news media outlets talk about "this is a monument that an officer is being charged."  Folks they mean white officers.  Black officers always get fired and charged.

Dumb black people are complaining about the lack of protests.  What is there to protest about in this case.  THIS IS THE SWIFTEST ACCOUNTABILITY I EVER SAW FOR LAW ENFORCEMENT.

OF COURSE DUMB IDIOTS THERE WILL BE NO PROTESTS IN MEMPHIS, THE COPS ARE BEING HELD TO THE HIGHEST STANDARD OF THE LAW.

GEESH!

Tyre Nichols Traffic Stop Video to be released 6:00 p.m. Friday January 27, 2023

After viewing this video footage maybe we should all revisit this discussion and consider our comments based upon actual video evidence...

IMHO, if a love one was killed by a law enforcement officer and video with audio evidence shows unnecessary, non-police protocol methods and decisions were made leading to their death - I could give a rats a-r-s-e if the law enforcement officers race was polka dot, pink, checker board, herringbone, tick weave or paisley - I want them fired and charged...

Treatment of the officer(s) would be the least of my last concerns...  Read that again, and note the glow highlighted detail prior to misinterpreting or misunderstanding what I wrote and responding

Walter Scott (African American) of North Charleston, was killed by  White Officer on April 4, 2015 and that White Officer was fired from his job on April 8, 2015 (4 days later) and inevitably charged with Murder - that White officer is currently serving a 20 year prison sentence...

Good Day Mates...

Iceman4221,

I think that's fair.  I also believe that if it was a loved one of mine, I wouldn't care the race I would just want justice.  I think that in this case justice is being served.  Officers were arrested swiftly.  The difference between the Scott case and this case IMO, is that the evidence in the Scott case was initiated by a private person behind the bushes who released video.  In this one we are waiting for the Government to release the body cam.  In many instances they don't want to release video immediately, under the guise of serving the public interest.  Like George Floyd, there had to be quicker response due to the fact that there was public video of the incident and not just body cam.  I want to continue a discussion on race and policing because I want all police (regardless of color) to be held to the highest standard of accountability, not just black ones.  There are too many examples of black one's being held fully accountable, and white one's being protected.

I don't think I'm going to watch the video. But, like Ben Crump stated" Why the black officers are brought up on charges, fired and the white officers go under investigation before they're fired or reinstated? That's some think piece there.

Not to make light of the situation. But did yall see Mrs. Nichols fix her hair before the camera. One thing a Black woman is going to do, is make sure she is camera ready :)

RIP Mr. Nichols

Also too add, this is a Black female police chief who doesn't play the radio. Her actions were swift and demonstrated accountability unlike her brethern chiefs across the country. That the officers that committed this crime happened to be Black has no bearing.

THIS IS WHAT IS SUPPOSED TO HAPPEN WHEN OFFICERS [5] KILL AN INNOCENT PERSON. NEWSFLASH: THEY SHOULDN'T BE KILLING PERCEIVED GUILTY FOLKS EITHER!!!!

Swift! Just. AND IF found innocent, they can be reinstated later.

Unfortunately, this almost NEVER happens when the officers are white. We've seen that how many times? Too many to count.

Whether you care what color the officers are or not, trust me, those in power, ie, police chief, mayor of the city CLEARLY DO CARE!!!!

That broad went on CNN and said this incident now discounts race as a problem in policing. ::)

The nerve of her.
