Supreme Court Justices Neil Gorsuch and Ketanji Brown Jackson made an unlikely team on Tuesday by issuing a dissent against the majority's opinion to indefinitely keep Title 42 in place while the high court considers an argument from 19 mostly Republican-led states.

Those states challenged a district court's ruling last month that would vacate Title 42, which was enacted by the Trump administration in March 2020 to allow officials to expel migrants on public health grounds.

Gorsuch, a Trump appointee, wrote the dissent and was joined by Jackson, who President Biden nominated earlier this year.

The two justices argued the Biden administration and Congress have failed to address adequately the immigration crisis that is likely coming after Title 42 is vacated, but wrote that it is not the Supreme Court's job to issue policies where elected leaders fail.

My president, Joseph Robinette Biden, Jr., got smacked down by his own pick for the United States Supreme Court.  She sided with Republicans.  Good for her.

No y04185. It appears you misunderstand the Court's ruling. Five Conservative Justices voted to keep Title 42 in place. Justices Neil Gorsuch and Ketanji Brown Jackson dissented.

Title 42 was a Trump administration policy that  was originally enacted at the outset of the coronavirus pandemic in March 2020. Title 42 allows immigration officials to quickly expel migrants on public health grounds.

In Tuesday's 5-4 ruling, Justices Roberts, Samuel Alito, Brett Kavanaugh, Amy Coney Barrett and Clarence Thomas agreed to hear a challenge from Republican-led states during the February 2023 argu­ment session.

Every administration keeps kicking the can down the road to the next administration instead of just tackling the situation head on. Instead of legislating the situation they ALL have made it a partisan issue. We need to shut the borders, get this under control, put in the proper controls and LEGISLATE. We cannot be two things at one.  Yes, there are racial undertones, but the crux of the problem is nothing is in place. We have created a humanitarian issue by not securing and enforcing our own borders. This should be an easy fix, but way too many are worried about optics then legislation.
