Judge rebukes GOP for downplaying US Capitol riot as he hands out first sentence in insurrection

A Trump supporter who spent 10 minutes inside the US Capitol during the January 6 insurrection was sentenced to probation Wednesday, avoiding jail, becoming the first rioter to learn their punishment in the riot investigation.

At a hearing in DC federal court, Judge Royce Lamberth said the insurrection was a "disgrace" and forcefully rebuked the "utter nonsense" coming from some Republican lawmakers and other right-wing figures who are whitewashing what happened.
"I don't know what planet they were on," Lamberth said of the GOP lawmakers, without mentioning any names. Recent releases of videos from the attack "will show the attempt of some congressman to rewrite history that these were tourists walking through the capitol is utter nonsense."

Anna Morgan-Lloyd, 49, from rural Indiana, had pleaded guilty to a single misdemeanor for trespassing inside the Capitol as part of the crowd on January 6. She was also assessed a $500 fine.
Lamberth said Morgan-Lloyd avoided jail time because she didn't participate in the violence and condemned those who did. He issued a warning to other defendants that he'll likely sentence them to jail time if they continue defending their behavior at the Capitol.

An Indiana woman became the first person sentenced in the January riot at the U.S. Capitol on Wednesday after entering a guilty plea and telling the court she's since educated herself with movies such as “Schindler’s List.”

Anna Morgan-Lloyd pleaded guilty in federal court to one charge of parading, demonstrating or picketing in a Capitol building in exchange for three years of probation, $500 in restitution and 40 hours of community service, court records show.

The court prohibited Morgan-Lloyd from buying a firearm under the terms of her probation.

U.S. District Judge Royce Lamberth delivered the 49-year-old Bloomfield woman her sentence on Wednesday afternoon in a teleconference hearing.

"I have really struggled with what would be an appropriate sentence," Lamberth said.

She was only charged with trespassing as a first offender. If she should have gotten more time, maybe the U.S. Attorney's Office should have charged her with a more serious crime.

I have a sinking feeling that these low hanging fruit--ain't a one of 'em going to get any serious jail time. They're all gonna slide and the left is going to go "see how nice we were to the criminals" and leave it open to happen again.

We all know that they aren't kids, and they don't need guidance or instruction. They knew exactly what they were doing that day and they're going to get away with it.

Just like congress not policing itself with the 14th Amendment.

Opportunities lost now are going to return bloody result in the future

New Oath Keeper defendant cooperating against others in major January 6 conspiracy case

(CNN)A member of the Oath Keepers has cut a plea deal with prosecutors and is testifying secretly against others in the right-wing group, according to a criminal case unsealed Wednesday in Washington, DC.

The newly public case is the latest known move by the Justice Department to prosecute the extremist group for planning the January 6 attack on Congress.
Mark Grods is set to plead guilty to two charges -- conspiracy and obstruction of Congress' certification of the electoral college.

He plans to admit to taking part in paramilitary training efforts before January 6 and recruiting people to come to DC and join together for the siege. Grods and others brought firearms, combat outfits, helmets and radio equipment for the siege, according to the charging document.

Grods also plans to admit to allegations that he stormed the Capitol with others, taking part in the military-style "stack" formation used by the Oath Keepers to cut through the crowd, while carrying a "large stick," according to his court record.

Grods' plea deal was filed in court confidentially on Monday and made public Wednesday morning. The secrecy would "ensure the defendant's safety while he cooperates pursuant to his plea agreement and testifies before the grand jury," a court filing from the Justice Department said.

Grods is set to appear before a judge in DC federal court at 2 p.m. ET Wednesday.

CNN has reached out to Grod's lawyer for comment.

Grods stayed at the Mayflower Hotel while in DC, though he had handed off guns to another person to keep at a hotel in Virginia, his charging document says.

Prosecutors have accused several Oath Keeper defendants of coordinating what they called a "Quick Reaction Force" -- by storing an arsenal across the river from DC in Virginia that could be brought in as backup if needed during the pro-Trump push to block Congress's certification of the 2020 election results.

Grods also rode in a pair of golf carts to get to the Capitol quickly, swerving around law enforcement, during the siege, his charging document says.

Grods was not charged previously in the sprawling conspiracy case against the Oath Keepers prosecutors have aggressively pursued.

In recent weeks, the Justice Department flipped one of the conspiracy co-defendants against the Oath Keepers in a plea deal secured last week -- a major step forward in the 16-defendant case -- and also gained a cooperator who had long-term ties to the organization and attended the January 6 riot.

Other Oath Keepers charged in the Capitol riot cases have pleaded not guilty.

First US Capitol rioter convicted of a felony gets 8 months in prison after DOJ says stiffer sentence could stop future attacks

(CNN)A man who pleaded guilty to breaching the Senate chamber during the US Capitol insurrection was sentenced Monday to eight months in prison in a closely watched case that could influence how hundreds of other rioters charged with the same felony are punished.

Paul Hodgkins, a 38-year-old Floridian, is now the first Capitol rioter convicted of a felony to be sentenced. He pleaded guilty last month to obstructing congressional proceedings -- specifically, the counting of the electoral votes, which he helped delay on January 6. He spent about 15 minutes inside the Senate chamber, wearing a Donald Trump shirt and carrying a Trump flag.
The sentence is far less than the 1.5-year prison term that the Justice Department requested. At a hearing Monday, prosecutors argued that 1.5 years would deter future political violence and send a strong warning to "people who may be contemplating a second act" after January 6.
District Judge Randolph Moss departed from that recommendation. He said Hodgkins contributed to a grave offense against democracy but deserved some leniency because he pleaded guilty "exceptionally early," wasn't involved in violence and issued a "sincere" apology.
"Hodgkins was staking a claim on the floor of the United States Senate, not with the American flag but with a flag declaring his loyalty to a single individual over the entire nation," Moss said.
"When a mob is prepared to attack the Capitol to prevent elected officials from both parties from performing their constitutional and statutory duty, democracy is in trouble," Moss added.
