Dear CIAA-FAN,

It looks like Baltimore police are trying to blame Freddie Gray for his own death.

Police and prosecutors are refusing to officially release information about the investigation into Freddie Gray's death. But at the same time, someone just leaked a police document that quotes a prisoner who rode in the same van as Gray, saying that Gray "was intentionally trying to injure himself."1This anonymous leak almost certainly came from someone in the Baltimore police department.

It's despicable. And it's exactly the same type of victim-blaming we saw years ago when Baltimore police gave another Baltimore resident a "rough ride," paralyzing him and eventually killing him in a hauntingly similar case.2

We've seen time and time again what happens when police are given the authority and political cover to police themselves. No transparency. No accountability. No prosecution. Unless Governor Hogan brings independent oversight to this case, we can expect the same familiar miscarriage of justice.3,4

The prisoner quoted in this leak was separated from Gray by a metal barrier, so he couldn't have seen Gray. According to the leaked document, he claims he heard Gray banging on the walls, and that he thinks Gray was trying to hurt himself. But if Gray was banging on the walls, it could be because he was desperately trying to get help.5We already know that he had been requesting medical attention, and those requests were ignored.

And Gray might not have been banging on the walls at all. According to other versions of the story, Gray was unresponsive by the time the second person was loaded into the van.6Whatever happened, what's clear is that this leak is an attempt to shape the story in a way that absolves police of responsibility — at a time when law enforcement is refusing to release other information about the case.

Nearly 40,000 ColorOfChange members are urging Governor Hogan to send Attorney General Frosh to support the investigation and prosecution of Freddie Gray's death. This leak makes it clear that the current investigation cannot be trusted. Baltimore police and State's Attorney Marilyn Mosby are heading down the same path of denied justice that has allowed Baltimore's crisis of discriminatory police violence to flourish for years.

In 2014, 100% of people killed by Baltimore Police were Black. And almost none of those officers have ever been held accountable.7 Over the past 5 years, Baltimore police have paid millions to people injured and paralyzed by police "rough rides."8 Freddie Gray was killed. And his family, Baltimore, and America have the right to an independent investigation that gets to the bottom of what happened and ensures the greatest measure of justice.

Take action to escalate pressure on Governor Hogan and build the widespread support we will need to win.

The six Baltimore police officers involved in the arrest of Freddie Gray – who died last month after being injured in police custody – have been charged criminally, State's Attorney Marilyn Mosby announced Friday.

Officer Caesar Goodson Jr., 45, who was the driver of a police van that carried Gray through the streets of Baltimore, was charged with second-degree murder, manslaughter, second-degree assault, two vehicular manslaughter charges and misconduct in office.

Officer William Porter, 25, was charged with involuntary manslaughter, second-degree assault and misconduct in office.

Lt. Brian Rice, 41, was charged with involuntary manslaughter, second-degree assault and misconduct in office.

Sgt. Alicia White, 30, was charged with involuntary manslaughter, second-degree assault and misconduct in office.

Officer Edward Nero, 29, was charged with second-degree assault and misconduct in office.

Officer Garrett Miller, 26, was charged with second-degree assault, misconduct in office and false imprisonment.

Warrants were issued for the arrest of all six officers. It wasn't immediately clear where the officers were on Friday morning.

Mosby's announcement on the steps of the War Memorial Building was greeted with cheers and applause. She said she told Gray's family that "no one is above the law."

Gray, 25, was chased down and arrested by Baltimore officers on April 12 and died a week later. His family has said he suffered a spinal cord injury and a crushed voice box.

After bystander video of the arrest surfaced, showing Gray dragging his feet as he was put in a police transport van, there have been cries for charges against the officers.

Mosby said Gray was improperly arrested on April 12 because officers had no probable cause to detain him.

In a detailed recounting of the events, Mosby described Gray being repeatedly denied medical attention by police officers, even as he asked for medical help and later was unresponsive in a police van.

Gray suffered a "severe and critical neck injury" as a result of being handcuffed, shackled and being unrestrained in the van.

Mosby said an investigation found officers bound Gray's wrists and ankles and left him stomach-down on the floor of a police van as they drove around West Baltimore. Despite his repeated requests for medical attention, they did not provide it and continued to drive without securing him in the van, she said.

Officers on at least five occasions placed Gray in the van or checked on him and failed to secure him, she said. By the time they reached the Western District police station, he was not breathing and in cardiac arrest, she said.

Mosby said her office did a "comprehensive, thorough and independent" investigation that began April 13, the day after Gray was injured.

"My team worked around the clock, 12- and 14-hour days," she said.

Mosby worked quickly in determining charges. Balitmore Police handed over their investigation to her office on Thursday, one day earlier than they had promised.

The Fraternal Order of Police asked Mosby to appoint an independent prosecutor in the case, citing her ties to the Gray family's attorney, Billy Murphy, as well as her lead prosecutor's connections to members of the local media.

"While I have the utmost respect for you and your office, I have very deep concerns about the many conflicts of interest presented by your office conducting an investigation in this case," wrote Gene Ryan, president of FOP Lodge 3.

The FOP letter also expresses problems with Mosby's marriage to Baltimore City Councilman Nick Mosby.

"Most importantly, it is clear that your husband's political future will be directly impacted, for better or worse, by the outcome of your investigation," the letter states. "In order to avoid any appearance of impropriety or a violation of the Professional Rules of Professional Responsibilty, I ask that you appoint a Special Prosecutor to determine whether or not any charges should be filed."

Mosby responded to that request by saying: "The people of Baltimore City elected me and there is no accountability with a special prosecutor."

"I will prosecute any case within my jurisdiction," Mosby added.

Following Gray's death, demonstrations and protests began peacefully but turned violent on Saturday and Monday. Monday's events included rioting, arson and property damage in pockets of the city.

Officials responded by declaring a state of emergency, instituting a nightly curfew and calling in help from state troopers and the Maryland National Guard.

Mosby called on the public to remain calm.

"I heard your call for 'no justice, no peace,'" she said. "Your peace is sincerely needed as I work to deliver justice on behalf of this young man."

Word traveled quickly of the charges against the officers. In West Baltimore, cars honked their horns. A man hanging out of a truck window pumped his fists and yelled; "Justice! Justice! Justice!"

At the corner where Gray was arrested, 53-year-old Willie Rooks held his hands up in peace signs and screamed, "Justice!"

Meecah Tucker, 23, wearing a T-shirt that read, "I Bleed Baltimore," said: "If it was one of us doing that against a police officer, it would be first-degree murder."

Interesting Scenario. In many of these cases where Blacks are killed by police officers under questionable circumstances, the Black community have suggested or requested that a special prosecutor be assigned to the case because the local prosecutors work to closely with the police. However, in this instannce the Police are asking that a special prosecutor be appointed because the elected prosecutor is too close to the attorney for the victim's family and the lead prosecutor is too close to the media.  :shrug: What the hell?

Nope. I'm guessing the FOP will keeep this fight in the Court and not in the streets.  They will go to the media with the argument that Mosby should recuse herself and appoint a special prosecutor. After that is resolved, the rest of this fight is going to be in the Courthouse.

Nope. I'm guessing the FOP will keeep this fight in the Court and not in the streets.  They will go to the media with the argument that Mosby should recuse herself and appoint a special prosecutor. After that is resolved, the rest of this fight is going to be in the Courthouse.

In Eric Garner case, Garner was resisting; he had asthma;  and a grand jury declined to indict the officer that choked Garner to death.  De Blasio drew criticism from New York Police Union because he made a public comment about having to talk to his son about how to interact with the police. The police union felt they were thrown under  the bus. Police officers turned their backs to  De Blasio at some events. Police Union president Lynch made public comments attacking De Blasio.

In Freddie Gray case, there is less wiggle room for the police officer-defendants; they have already been charged; Ms. Mosby is not a mayor, she is a prosecutor; I doubt that she will make any public statements which reflect negatively on the police department during the pendency of this case; and  I doubt that she will make any public ccomments as to the guilt of the police officer-defendants during the pendency of the case, as that would violate her ethical duty as a prosecutor. Moreover, if Ms. Mosby acts professionally, the Baltimore FOP will have to consider how will it look if they publically attack an African-American Prosecutor. Those optics, a term with which you are fond, will not look good for them.


Yeah, the only public fight they are going to have with Ms. Mosby is the one to ger her recused. That is my prediction.

In the letter the FOP asked that the an independent prosecutor be appointed to determine whether charges should be filed. The decision to file charges has already been made.  The FOP could try to  get an court order for Mosby to recuse herself. However, seriously doubt that a Court would grant that motion. The FOP and/or the lawyers for the defendant may file for a change of venue but if successful, a change of venue only moves the trial to someplace in Maryland other than Baltimore. A change of venue does not get a different prosecutor.

OFFICER CAESAR R. GOODSON Jr.

Goodson was the driver of the van that transported Freddie Gray, and he faces the most serious charges. Mosby said Friday that Goodson repeatedly failed — at least five times — to seatbelt Gray in the transport vehicle. Overall, Goodson faces six charges, including "second-degree depraved heart murder," which carries a potential 30-year sentence.

Goodson, 45, has been on the force since 1999, and like two others charged in Gray's death is black. Online court records list the three other officers' race in a category that includes Caucasians and people of Arab descent.

Friends describe Goodson as a family man who likes to watch football and works part time as an auto mechanic at a shop specializing in Saabs. With help, he restored a green Saab convertible, a car one friend says he only takes out a few times a year. He wasn't scheduled to work on the day Gray was arrested but had been asked to work overtime, friends said.

A friend who worked with him as a mechanic said Goodson had hoped to retire in several years.

An obituary for his mother published in the Baltimore Sun in 2012 says his grandfather was a police officer.

LT. BRIAN W. RICE

Rice was on bike patrol when he made eye contact with Freddie Gray on a Baltimore street April 12. Gray ran, and Rice pursued him. Bike patrol officers Garrett Miller and Edward Nero joined the pursuit.

Rice, 41, is the most senior officer to be charged. He joined the police force in 1997 and was promoted to lieutenant in 2011, police said. Records obtained by The Associated Press from a sheriff's department and court show he was hospitalized in April 2012 following concerns about his mental health. Worries about his stability led deputies to confiscate both his official and personal guns, and his commanding officer was called. It was not immediately clear whether or when all of Rice's guns were returned.

OFFICER GARRETT E. MILLER AND OFFICER EDWARD M. NERO

Gray surrendered to Miller, 26, and Nero, 29. Miller and Nero handcuffed Gray and put him on the ground. Gray told the officers that he couldn't breathe and requested an inhaler, Mosby said. The two officers, both of whom joined the police force in 2012, sat Gray up and found a folded knife clipped to the inside of his pants pocket, a knife that is lawful under Maryland law, Mosby said. Previously, police have said they found a switchblade.

Mosby said Gray didn't commit any crime, and the officers "illegally arrested Mr. Gray."

The officers put the knife on the sidewalk and then put Gray back down on his stomach, when he started to flail his legs and scream, Mosby said.

Nero held Gray down until Goodson arrived driving a police transport van. Miller, Nero and Rice then put Gray inside.

White is the second-highest officer charged in the Gray case. She met the van at its stop to pick up the second person. White, 30, was responsible for investigating two citizen complaints about Gray's arrest. White, who is black, joined the police in 2010 and was recently made a sergeant in January 2015, police said.

During the stop, White, Goodson and Porter saw Gray unresponsive on the floor. White "spoke to the back of Gray's head" but he did not respond, Mosby said. The group did not call for medical assistance.
