TORRANCE, Calif. — A woman who expected her 2006 Honda Civic Hybrid to be her dream car wants Honda to pay for not delivering the high mileage it promised. But rather than joining other owners in a class-action lawsuit, she is going solo in small claims court, an unusual move that could offer a bigger payout if it doesn't backfire.

A trial is set for Tuesday afternoon in Torrance, where American Honda Motor Co. has its West Coast headquarters.

Heather Peters says her car never came close to getting the promised 50 miles per gallon, and as its battery deteriorated, it was getting only 30 mpg. She wants Honda to pay for her trouble and the extra money she spent on gas.

Peters, a former lawyer who long ago gave up her bar card, has devised a unique legal vehicle to drive Honda into court — a small claims suit that could cost the company up to $10,000 in her case and every other individual case filed in the same manner.

If other claimants follow her lead, she estimates Honda could be forced to pay $2 billion in damages. No high-priced lawyers are involved and the process is streamlined.

The upside of Peters' unusual move, she says, is that litigants are not allowed to have lawyers argue in small claims court in California. This means any award will not be diluted by attorney's fees. Honda would have to appoint a non-lawyer employee to argue its side in court.

My 2005 Civic Hybrid got 40 mpg from the day I took the keys to the day I traded it in.

I could EASILY get 45 mpg highway driving between 65-70 and 38-42 mpg in the city.

It was VERY comfortable, even for a big man like me, and NEVER gave me ANY serious mechanical problems.

Now it was EXPENSIVE AS HELL to keep up. Scheduled maintainence ran anywhere from $132-$225 and the tune-up was almost $800!

Plus with it getting older, the batteries were reaching their lifetime limit and it would have cost over $5,000 to replace them.

I got $4800 on the trade... pretty good for a car with 162,000 miles on it and the new owner is VERY happy I hear. Wink

This woman is full of crap. Roll Eyes

Cholly, did Honda promise 50mph when you bought your battery operated rice burner?  Honda promised her 50mph.  She got a lot less.  She chose to not go the Class Action route.  There must have been a problem with her 2006 because there is a class action against Honda.   She's not the one full of s**t.  You are.

Cholly, you are comparing apples to oranges again.  You did not have a 2006 Honda Hybrid.  You had a 2005.  Was there a class action suit against Honda for 2005 Hybrids?  It appears that the problem is with the 2006 model.  She was told by Honda that she would get 50 mpg.  She got 40 mpg.  That's a 20% difference. 

I hope she is successful. 

I'm glad your hybrid exceeded what Honda claimed you would get.  Most vehicles I have owned I got better gas mileage that was advertised.  There has never been a 20% difference.

Cholly, she is suing because of what Honda claimed.  Not what the feds claimed.  You are correct.  Reading is fundamental.  You should try it sometime.

And YOU should try thinking:

What exactly was the contract/contractual arrangement between that disbarred golddigger and Honda Motors?

Was the MPG claim explicit or implied?

What type of maintainence did the vehicle in question undergo?

What is the mileage average of OTHER Civics in her cars production run?

It'll get tossed out of court before YOU can blink and think... which is to say, it will take a few days.  tiptoe

Cholly, it is already in court.  There is a Class Action against Honda.  Reading comprehension is not your forte.  This case will NOT be thrown out.  You should read the full story before posting your dribble.  She will win her case.  It is just a matter of how much.  If it's more than $200 she wins.  I'm sure she will present the math showing the cost of fuel between 50mpg and 40mpg.  I hope she wins and gets the $10K.   nod
